Mr. Steen

asked the Secretary of State for Transport if he has confirmed any byelaws made by the Dart harbour and navigation authorities for the purpose of regulating the placing and use of moorings and determining the appropriate charges for licences for such moorings.

Under byelaw 41, confirmed in 1978, the permission of the harbour master is required for moorings. Powers to control and to licence moorings are also contained in section 33 of the Dart Harbour and Navigation Authority Act 1975, which provides, among other things, that the licence fee shall not exceed the cost of granting the licence and of supervising the mooring in question.

Mr. Steen

asked the Secretary of State for Transport if he has given any consent under section 65(1)(b) of the Dart Harbour and Navigation Authority Act 1975 to the authority for borrowing capital or any consent under section 66(2) since the authority was established; and, if so, when and for what purpose.

Mr. David Mitchell

The authority has not sought such consents.
