Young prisoners together with borstal trainees awaiting allocation are held on two landings of a wing of Birmingham prison. As far as possible they are kept separate from the adult prisoners. Untried young prisoners are normally held in Birmingham prison only if they are facing a murder charge in which case they are located in the hospital.
Mr. Ball is; and my right hon. Friend is not prepared to depart from that practice in his case. Having considered the tribunal's advice, my right hon. Friend is of the opinion that Mr. Ball remains mentally disordered and must continue to be detained in hospital in order to receive further treatment and for the protection of the public.
