Mr. Carter-Jones

asked the Secretary of State for Social Services in what circumstances overseas students are deemed to be ordinarily resident in the United Kingdom for the purposes of entitlement to attendance allowance and mobility allowance; and if he will make a statement.

Mr. Rossi

An overseas student in this country who applies for attendance allowance or mobility allowance is treated in the same way as any other person coming from abroad. It is for the independent statutory authorities to determine whether a person is ordinarily resident in Great Britain on the basis of the claimant's particular circumstances.
