Mr. Dixon

asked the Secretary of State for the Environment (1) if he will take steps to amend section 22 of the Town and Country Planning Act 1971 by inserting provisions to define the introduction of a major hazard as a material change of use;

(2) if he will take steps to amend the Town and Country Planning (Use Classes) Order 1972 to define uses which are defined as major hazards in regulations made under the Health and Safety at Work etc. Act 1974 as separate uses not linked to other industrial uses;

(3) if he will take steps to amend the Town and Country Planning General Development Order 1977 to ensure that the introduction of a use defined as a notifiable hazard in regulations made under the Health and Safety at Work etc. Act 1974 or the intensification of an existing use to bring it within such definition as a notifiable hazard is not development permitted under the order.

Similar proposals have been made by the Advisory Committee on Major Hazards in its second report to the Health and Safety Commission. My right hon. Friend will consider sympathetically any recommendations which the commission put to Ministers.
