asked the Secretary of State for Transport if he will make a statement on how he intends to operate the provisions of section 113 of the Local Government, Planning and Land Act 1980.

We intend, in the first place, to publicise these provisions generally so that the public can be made aware that claims can now be made for compensation for depreciation in the value of property due to noise and nuisance from new or altered trunk roads and motorways even though the original claim period has expired in certain cases where the original publicity arrangements were inadequate.

Secondly, we will publicise the new provisions more specifically in the areas where there appears to be a prima facie case that the original publicity for a road scheme was inadequate.

Thirdly, the Department will be getting in touch direct with all those householders who have raised the matter over the last few years, including those whose earlier approaches were rejected under the law as it then stood.
