§ Mr. Staintonasked the Secretary of state for Trade to what extent United Kingdom charities incorporated under section 19 of the Companies Acts are outside the scope of EEC directives by virtue of the definition of companies in article 58 of the Treaty of Rome.
§ Mr. EyreThe definition of "companies or firms" in article 58 of the Treaty of Rome excludes those which are non-profit making. Thus United Kingdom charities incorporated as companies which are licensed to dispense with the word "limited" in their name under section 19 of the Companies Act 1948, and other non-commercial bodies, are outside the scope of EC company law directives based on article 54.3 (g) of the Treaty which applies the definition in article 58.
