asked Her Majesty's Government:

Whether, having regard to the special significance of Epsom Downs, not only as the home of the Epsom Derby, the most prestigious race in the world, but also for the citizens of Epsom and South London as a regional open space for recreation, they will make an order under Section 262(9) of the Local Government Act 1972 continuing the Epsom and Walton Downs Regulation Act 1936 until the end of 1989 so that consultations can take place and proper consideration can be given to this unique local statute which would otherwise expire at the end of 1984 and without which the future of the Epsom Derby would be placed in jeopardy.

I understand that the Epsom and Ewell Borough Council have it in mind to promote before 1984 a Private Bill which, if enacted, would replace the Epsom and Walton Downs Regulation Act 1936. The question of any need to continue that Act in force after the end of 1984 is therefore premature at this stage. I am also advised that an order under Section 262(9) of the Local Government Act 1972 could not be confined solely to the Act of 1936. My right honourable friend will consider at the appropriate time whether an order of more general application under Section 262(9) should be made and, if so, for what period.
