HC Deb 07 March 1979 vol 963 c673W
Mr. Stephen Ross

asked the Attorney-General whether he intends to seek to amend the law relating to divorced husbands so as to ensure that they can obtain a fairer share of the assets of the former partnership.

The Solicitor-General

No. The law already ensures that divorced husbands can obtain a fair share of the assets. In particular, section 24 of the Matrimonial Causes Act 1973 preserves the discretion of the court to make orders for the division of assets between divorced persons and section 25 requires the court, in making such an order, to have regard to all the circumstances of the case including the financial resources of the parties. If the hon. Member has any specific proposals, my noble Friend will be glad to consider them.
