HL Deb 06 March 1979 vol 399 cc166-7WA
Lord O'HAGAN

asked Her Majesty's Government.

How far the proceedings of the European Parliament, broadcast or reported in the United Kingdom, enjoy the same legal immunities as the proceedings of the Houses of the British Parliament.

The MINISTER of STATE, FOREIGN and COMMONWEALTH OFFICE (Lord Goronwy-Roberts)

Fair and accurate newspaper reports and broadcasts of the proceedings of either House of Parliament are at common law immune from any proceedings for defamation, provided the report is made honestly and without any direct or improper motive. A broadly corresponding qualified privilege is conferred on reports of proceedings in the European Assembly by Sections 7 and 9 of the Defamation Act 1952.
