asked the Secretary of State for the Home Department if he will outline in detail the main considerations which he takes into account when using his discretion to allow or refuse extradition after the magistrates' hearing.

Both the Extradition Act 1870 and the Fugitive Offenders Act 1967 confer on me a residual discretion not to surrender a fugitive committed by the courts. Each case is considered on its merits and I cannot itemise criteria for the exercise of this discretion, which has been used very rarely.
