§ Mr. Merlyn ReesBoth the Extradition Act 1870 and the Fugitive Offenders Act 1967 confer on me a residual discretion not to surrender a fugitive committed by the courts. Each case is considered on its merits and I cannot itemise criteria for the exercise of this discretion, which has been used very rarely.
