asked the Secretary of State for the Home Department whether he considers proceedings issued before the European Commission of Human Rights to be legal proceedings such as to entitle the prisoner to the privilege contained in Rule 37A(i) of the Prison Rules 1964 as amended; and, if not, why not.

I am advised that Prison Rule 37A(1) does not apply to correspondence between a prisoner and his legal adviser in connection with the consideration, examination and investigation of his petition by the European Commission of Human Rights under Articles 25 to 28 of the European Convention on Human Rights, on the grounds that the functions performed by the Commission under these Articles do not amount to legal proceedings as that expression is used in the rule.
