asked the Secretary of State for Employment how many employers have been fined for failure to notify the Secretary of State for Employment of intended redundances; and what have been the total and average amounts of such fines.

Mr. John Golding:

From 8th March 1976—the date on which the provisions of Part IV of the Employment Protection Act 1975 came into force—to 31st August 1977 action to reduce redundancy payments rebate under the terms of Section 104 of the Act was taken in 169 cases. The total sum of these reductions amounted to approximately £15,500; the average penalty therefore amounting to £91.70.

No prosecutions have as yet been made under Section 105 of the Act.
