asked the Attorney-General if he will inquire into the circumstances in which a 13 year old girl came to be prosecuted for abortion under the provisions of the Offences Against the Person Act 1861.

The Attorney-General

I am aware of the circumstances leading to the prosecution under Section 58 of the Offences Against the Person Act 1861. The Director of Public Prosecutions has acknowledged that the advice which led to the institution of the proceedings was wrong. My right hon. Friend the Secretary of State for the Home Department has recommended the exercise of the Prerogative of Mercy to grant a free pardon.
