§ 24. Mr. Hoyleasked the Secretary of State for the Home Department if he will bring forward proposals to reform the machinery for deportation.
§ Mr. Merlyn ReesSections 3(5) and (6) of the Immigration Act 1971 provide that a person who is not patrial shall be liable to deportation under the following heads:
- (i) following a court recommendation;
- (ii) breach of a condition attached to leave to enter or remain or overstaying;
- (iii) if Secretary of State deems it conducive to the public good;
- (iv) as a member of the family of a person already ordered to be deported.
I am always prepared to discuss machinery for deportation but not any particular case where there is an element of sub judice.
