HC Deb 03 March 1977 vol 927 cc260-1W
24. Mr. Hoyle

asked the Secretary of State for the Home Department if he will bring forward proposals to reform the machinery for deportation.

Mr. Merlyn Rees

Sections 3(5) and (6) of the Immigration Act 1971 provide that a person who is not patrial shall be liable to deportation under the following heads:

  1. (i) following a court recommendation;
  2. (ii) breach of a condition attached to leave to enter or remain or overstaying;
  3. (iii) if Secretary of State deems it conducive to the public good;
  4. (iv) as a member of the family of a person already ordered to be deported.

I am always prepared to discuss machinery for deportation but not any particular case where there is an element of sub judice.
