HC Deb 04 February 1977 vol 925 cc444-5W
Sir Frederic Bennett

asked the Attorney-General if he will list all the offences for the prosecution of which his consent is necessary, which also require his consent in the obtaining of (a) a declaratory judgment, (b) a temporary injunction and (c) a permanent injunction, respectively.

The Attorney-General

There are a substantial number of offences which by the statute creating them may only be prosecuted with my consent. Those statutes do not, however, deal in terms with the position in relation to civil proceedings, whether for an injunction or for a declaration, founded upon an allegation that such an offence has been committed or that its commission is apprehended. That question depends upon the extent of the Attorney-General's inherent powers and is, therefore, part of the issue in the case of Gourietv. U.P.W. and others, which will, I hope, lead to the clarification of the law on appeal to the House of Lords.
