asked the Secretary of State for the Environment (1) whether he intends to make regulations, providing a procedure governing appeals to himself against a decision of a disposal authority refusing or revoking a waste disposal licence under the Control of Pollution Act 1974, in place of the Circular which the Joint Committee on Statutory Instruments in its 24th Report of last Session (HC 54-xxxiii) considered to be a surprising way in which to implement the requirements of the Act;

(2) whether he intends to make regulations, providing a procedure governing appeals arising out of the exercise of powers under the Control of Pollution (Discharges into Sewers) Regulations 1976, since the Joint Select Committee on Statutory Instruments in its 28th Report of last Session (HC 54-xxxix) described the provisions for appeals without provision for procedure thereon as an unexpected use of his powers.

Yes. Although there have been legal doubts about the power to prescribe appeal procedures under the relevant provision of the Act I now think it right to make regulations for this purpose. Consideration is at present being given to the form they should take.
