asked the Secretary of State for the Environment whether he will make a tree preservation order to stop the felling of trees at Honey Wood, Tyler Hill, Canterbury, in order to protect the woodland habitat of the nightingale and green woodpecker in the area, in view of the disappearance in the last two years due to extensive tree felling.

Mr. Denis Howell:

No. The primary responsibility rests with the local planning authority, who has power under Section 60 of the Town and Country Planning Act 1971 to make tree preservation orders in their area where they consider it expedient to do so in the interests of amenity.
