HC Deb 07 August 1975 vol 897 c425W
Sir J. Langford-Holt

asked the Secretary of State for the Home Department what redress is there for a person entitled to payment under a maintenance order by a magistrates' court, but who suffers loss as the result of delay or failure by the magistrates' clerk to initiate the appropriate process for the enforcement thereof.

Mr. Alexander W. Lyon

It would be open to the person concerned to seek compensation from the magistrates' courts committee, and if his claim were not accepted and he could establish negligence, to seek a remedy by an action for damages.
