asked the Secretary of State for the Environment if he will introduce legislation to protect local authorities against liability for damages in the event of appeals against refusal of planning permission being successful.

No. I am advised that no cause of action appears to lie against a local authority in respect of the exercise of its discretion in dealing with a planning application.
