asked the Secretary of State for the Environment if, in order to assist in providing the maximum availability of furnished, holiday flats for winter lettings, he will make a further statement clarifying the position regarding fixed termination tenancies for such accommodation.

The continued availability of furnished holiday flats both for holidays and for winter lettings is provided for in Case 10B in Section 3 of the Rent Act 1974. This creates an absolute ground for possession of a dwelling which had been let for a fixed term not exceeding eight months and which had been occupied for a holiday during the previous 12 months, provided that not later than the start of the tenancy the tenant was given notice that possession might be recovered under his case.
