Mr. Meacher

asked the Attorney-General what protection he proposes to offer to a house purchaser who, after incurring solicitor's fees, private surveyor's fees and building society surveyor's fees, finds that the vendor withdraws without liability to compensation immediately prior to the completion of the sale.

The Attorney-General

There is normally a remedy under the contract if a party withdraws without cause between contract and completion, but the purchaser usually prefers to make inquiries and financial arrangements before any binding obligation is concluded. This works both ways and either party may be let down by the other while the transaction is at the provisional stage. This does not necessarily operate to the advantage or disadvantage of vendors rather than purchasers.
