Mr. Godman Irvineasked the Secretary of State for the Environment if he will now amend Section 34 of the Public Health Act, 1936, on the lines discussed with the then Parliamentary Secretary to the Ministry of Housing and Local Government on 15th March, 1961, by the Clerk of the Battle Rural District Council and the hon. Member for Rye, and again in 1965 when a letter of 17th February was sent to the Clerk reporting that the representations had not been forgotten.

§ Mr. Michael HeseltineMy right hon. Friend does not think that he would be justified in introducing legislation specially to meet the Clerk's suggestion, which was that a local sewerage authority should have power to prohibit the discharge of rain-water from roofs and yards to a public sewer where satisfactory alternative arrangements could be made, e.g. by soakways. But I can assure my hon. Friend that he will consider the suggestion further when legislation to amend Part II of the Public Health Act, 1936, is again in prospect.
