asked the Secretary of State for the Home Department if he is aware that in some courts, when a motorist appeals successfully against a conviction in a magistrates' court, for a motoring offence, he is refused costs against the police; and if he will introduce legislation to prevent this.

Mr. Elystan Morgan:

The question whether a successful appellant should be awarded costs is entirely a matter for the court to decide. My right hon. Friend has no proposals for legislation on this subject.
