Mr. John Lee

asked the Attorney General if he will review the present law governing house property mortgages with a view to increasing the security of mortgagors against repossession by building societies.

The Attorney-General

Under Part IV of the Administration of Justice Bill (now in another place), which is based on proposals of the Committee on the Enforcement of Judgment Debts (Cmnd. 3909), the court will, in an action brought by a mortgagee for possession of a mortgaged dwelling-house, have a discretion to adjourn or stay proceedings to give the mortgagor an opportunity to pay sums due under the mortgage. The Bill applies to building societies and to other types of mortgagee.
