Mr. Fisher

asked the Secretary of State for the Home Department by what authority he has detained 13 Kenyan Asians in Canterbury gaol; how long they will be kept there; and what is the appeal procedure available to them under his regulations.

Mr. Judd

asked the Secretary of State for the Home Department by what authority he has detained young Kenyan Asians in Canterbury Prison: what consideration he gave to the number of Asians having United Kingdom citizenship now without employment prospects in Commonwealth countries in East Africa before reaching this decision; and whether he will make a statement on his policy in this matter.

Commonwealth citizens subject to immigration control who are refused admission to the United Kingdom are detained under power contained in the First Schedule to the Commonwealth Immigrants Act, 1962, pending further examination or the giving of removal directions. There is at present no formal appeal procedure, but representations received from or on behalf of a passenger are fully considered.
