HC Deb 19 March 1951 vol 485 cc228-9W
Sir J. Mellor

asked the Attorney-General if he will identify the powers, other than those specified, to which reference is made in Statutory Instrument, 1951, Number 210; and why these are not identified in the instrument.

The Attorney-General

There are no other specific powers under which these rules are made beyond those mentioned in the opening words. The reference to other powers is a formula which is usually and properly employed in Statutory Instruments to comprehend such ancillary powers as are or might be brought into play when a specific power is exercised. These ancillary powers are provisions of the general statutes law, for instance, those contained in the Interpretation Act, 1889, and the Statutory Instruments Act, 1946.

Sir J. Mellor

asked the Minister of Local Government and Planning if he will identify the powers, other than those specified, to which reference is made in Statutory Instrument, 1951, No. 207; and why these are not identified in the Instrument.

Mr. Dalton

I would refer the hon. Member to the reply given by my hon. Friend the Parliamentary Secretary to his Question last Monday.
