HC Deb 14 December 1939 vol 355 c1331W
Mr. Ede

asked the Minister of Agriculture what steps he takes to ensure that any encroachments on land subject to rights of common, permitted to Service Departments for purposes arising from the war, shall be abated at the end of hostilities?

Sir W. Womersley

Where Service Departments take possession of any land under the Defence Regulations, no special procedure is laid down in respect of land subject to rights of common, and my right hon. Friend is not necessarily consulted. As regards the period of their occupation of such land, the position of Service Departments does not differ from that of other competent authorities under the Defence Regulations and is governed by the Emergency Powers (Defence) Act,1939.
