asked the Minister of Transport whether his attention has been drawn to the fact that road surveyors still persist in using dangerous road surfacing in apparent disregard of his recommendation to use non-skid surfacing; and whether he will consider taking steps to make persons responsible for these dangers liable to penalties?

Mr. Burgin:

If the hon. Member has any particular case in mind, I will gladly make inquiries. As to the last part of the question, the hon. Member will be aware of the common law provisions whereby a highway authority may be held responsible for misfeasance.
