asked the President of the Board of Education whether the opinion of the local officers has been sought as to whether the action of the Birmingham local education authority, in postponing the operation of Section 10 of the Education Act, 1918, establishment of education schools after the appointed day had been fixed, is lawful; and whether he will state the view held on this matter?

Mr. FISHER

I have not taken the opinion of the Law Officers of the Crown on this question. An appointed day having been fixed in Birmingham for the purposes of Section 10 of the Education Act, 1918, it is clear that the provisions of that Section are in force there.
