§ Angela SmithLegal advice to the Department indicates that the proposed legislative amendment is outside the legislative competence of an Order in Council under the Northern Ireland Act 2001 as it 469W would make provision which is contrary to Community Law and/or contravenes a right granted under the European Convention on Human Rights.
Accordingly, it is not proposed to amend the legislation.
