§ Mr. MacleanThe eligibility of a claimant for compensation can be determined only by reference to the individual circumstances of the case in the light of the relevant scheme. In the great majority of cases where an application was made in respect of a fatal case under the 281W former tariff scheme, the claimants' eligibility for payment had not been determined when that scheme was withdrawn.
