Further to the Answer of the Earl of Arran on 27th January 1994 (H.L. Deb. WA86), whether a modification order by the surveying authority is different from a decision of the inspector and requires confirmation by the Secretary of State and not by the inspector himself.
§ The Earl of ArranThe surveying authority which makes a modification order is proposing a modification to the definitive map and statement. The decision of an inspector (who acts instead of the Secretary of State) is a decision whether or not to confirm the surveying authority's order. The inspector's decision requires no further confirmation.
