§ Mr. MichaelTo ask the Secretary of State for Transport (1) if he will list the(a) motoring offences which apply on unadopted highways and (b) motoring offences which apply only on adopted highways;
(2) if he will make it his policy to seek to amend the law to ensure that all drink driving legislation applies in circumstances where the road is unadopted.
§ Mr. Kenneth Carlisle[holding answer 21 January 1993]: The definition of "road" used in the Road Traffic Act 1988, in relation to England and Wales, includes any highway and any other road to which the public has access. Road traffic offences, including the drink-drive offences, therefore apply on all highways, whether adopted or not, and on certain other roads. The drink-drive offences and the offences involving dangerous or careless driving also extend to public places other than roads.
