Local Authority Tendering

Mr. Nicholas Brown

To ask the Secretary of State for the Environment what guidance he gives to local authorities involved in placing work out to tender with the private sector concerning the notification of changes by local authorities to the original specification once the original invitation to tender is issued and the tendering process is under way; and if he will list the relevant statutes.

My right hon. and learned Friend has not issued any guidance to local authorities on this specific aspect of tendering procedure.

The statutes relevant to public purchasing are:

—for compulsory competitive tendering:

• The Local Government, Planning and Land Act 1980
• The Local Government Act 1988
• The Local Government Act 1982

and regulations made under those Acts.

—for more general purchasing, regulations made to implement in the United Kingdom:

• (European Economic Community) Directive 71/305/EEC, as amended by 89/440/EEC. (Public Sector Works Directive)
• Directive 77/62/EEC, as amended by 88/295/EEC. (Supplies Directive)
• Directive 92/50/EEC. (Services Directive)
