§ 189. Mr. Cohen
To ask the Secretary of State for the Home Department which EC countries have enacted legislation based on the requirements of the Council of Europe convention on data protection, and have also applied the convention to manual files or have included requirements for obtaining the prior consent of data subjects to the use of their personal information.
§ Mr. Charles Wardle
All EC countries with the exception of Greece have enacted legislation which meets the requirements of the Council of Europe convention for the protection of individuals with regard to automatic processing of personal data. I understand that in Belgium, Denmark, France, Germany, the Netherlands, and Portugal, the legislation applies to manual files, as well as to computer files, either as a general rule or in some specific circumstances. I also understand that in Belgium, Denmark, France, Germany, Italy, Portugal, and Spain the data subject's consent is required in relation to the use either of all data or of sensitive data.
