HL Deb 13 December 1993 vol 550 cc91-2WA
Lord Spens

asked Her Majesty's Government:

Whether members of the Judicial Studies Board are or have been involved in sentencing policy in cases of serious fraud.

The Lord Chancellor (Lord Mackay of Clashfern)

The Judicial Studies Board is responsible for the training of judges. The board plays no part in sentencing policy; its function is to pass on to judges the guidelines laid down by the Court of Appeal Criminal Division.

Lord Spens

asked Her Majesty's Government:

Whether judges or members of the Judicial Studies Board have, during the last seven years, taken part in the pre-trial analysis of cases of serious fraud with a view to recommending appropriate sentences and whether the recommended sentences have, in due course, been applied.

The Lord Chancellor

The Judicial Studies Board is responsible for the training of judges. The board is not involved in sentencing policy nor in monitoring sentences. If the noble Lord is referring to preparatory hearings and/or pre-trial reviews of cases, their object is not that which he describes.
