To ask the Secretary of State for Health what statutory rights patients in special hospitals have to protect themselves from noise and nuisance generated by machinery being utilised by the hospital authorities or their agents.

National health service patients, including those in special hospitals, have the same rights to protection against noise as the public generally under health and safety and environmental protection legislation. Crown immunity was removed from health authorities in 1991 and this legislation is now fully enforceable in hospitals by the local statutory enforcement body.
