To ask the Secretary of State for the Environment upon what grounds EC member states can derogate from prohibitions on the killing of whales contained in(a) the habitats directive and (b) the Convention on International Trade in Endangered Species regulation EEC No. 3626/82; and if he will make a statement.

I refer the hon. Member to article 16 of council directive 92/43/EEC. There are no provisions for derogations of the type described in Council Regulation (EEC) No. 3626/92.
