§ Sir David SteelTo ask the Secretary of State for Scotland if he will bring forward provisions which will enable Scottish Homes to claw back any subsidy given to transferred Scottish Homes housing stock which is subsequently sold on the open market and which thereby generates a windfall profit.
§ Mr. LangNo. Scottish Homes already has the power to impose conditions on any financial assistance which it may provide in this connection. It is for it as owner of the stock to determine appropriate arrangements for clawback in the event of a subsequent disposal.
§ Sir David SteelTo ask the Secretary of State for Scotland if he will bring forward provisions to ensure that in assessing the continuing need for transferred Scottish Homes housing stock to remain available for affordable commercial renting, Scottish Homes will be required to take account of the recommendations of the district councils in their role as statutory local housing authorities.
§ Mr. LangNo. Scottish Homes has already been given guidance on the need to consult local authorities and to give careful consideration to their views. Scottish Homes in putting forward any proposals for the Secretary of State's consent will be expected to draw attention to any impact on the local authority's interest and on the authority's capacity to meet its continuing statutory housing obligations.
§ Sir David SteelTo ask the Secretary of State for Scotland whether valuations on Scottish Homes' housing stock will take account of any burdens on its disposal.
§ Mr. LangValuation of Scottish Homes' housing stock which is to be disposed to a new landlord will be set by the 457W district valuer who will take into account the market value subject to existing tenancies, the condition of the stock and the fact that tenants transferring will have a preserved right to buy.
