To ask the Secretary of State for the Environment what provisions govern the number of monthly instalments in which a local council may request their community charge must be paid.

Our regulations provide that the charge is payable in 10 monthly instalments or, if less, the number of whole months remaining after the issue of the notice, less one. However, these regulations have recently been amended so that when a demand notice is issued in May the number of instalments offered may be 10 or nine. These provisions are contained in schedule 1 to the Community Charges (Administration and Enforcement) Regulations 1989 (S.I. 1989 No. 438) as amended by the Community Charges and Non-Domestic Rating (Miscellaneous Provisions) Regulations 1991 (SI 1991 No. 1127).
