To ask the Secretary of State for the Environment what steps he has taken to ensure that the Transfrontier Shipment of Hazardous Waste Regulations 1988 are consistently applied in accordance with directives 84/661/EEC and 86/297/EEC.

Mr. Trippier

The Transfrontier Shipment of Hazardous Waste Regulations 1988 implement the provisions of Council directives 84/631/EEC and 86/279/EEC and two related Commission directives. Enforcement of the provisions is primarily a matter for waste disposal authorities and comprehensive advice is contained in circular 16/89 issued by the Department.

To ask the Secretary of State for the Environment what steps he is taking to revise the operation of the Transfrontier Shipment of Hazardous Waste Regulations 1988; what discussions he has had; and with whom.

Mr. Trippier

The Transfrontier Shipment of Hazardous Waste Regulations 1988 will need modification in due course to implement future changes in Community law which, inter alia, will enable member states to ratify the Basel convention. My right hon. Friend the Secretary of State has raised the matter in the EC Environment Council and detailed discussions within the Community are under way.
