HL Deb 03 July 1989 vol 509 cc1056-7WA
Lord Denning

asked Her Majesty's Government:

Whether in implementing its "practice" in connection with discontinued denominational voluntary schools (referred to in paragraph 76 of the Report of the Charity Commissioners for 1988) the Department of Education and Science complied in each case with the requirements of Section 2 of the Education Act 1973, and in particular with the requirement that the endowments should be used for appropriate educational purposes "related to the locality served or formerly served by the voluntary school at the premises".

Viscount Davidson

In making orders in respect of discontinued denominational voluntary schools (under the circumstances described in paragraph 76 of the Report of the Charity Commissioners for 1988) the Department of Education and Science complied in each case with the requirements of Section 2 of the Education Act 1973.

Where a request was received from trustees, and with the agreement of the diocese, such orders provided for the endowments to be used partly for the benefit of the locality served or formerly served by the voluntary school by providing for a proportion of the trust assets to be made available for promoting religious education in the parish by means of a Sunday school fund.
