§ Mr. EadieTo ask the Secretary of State for Scotland, if the civil justice review White Paper proposed to be published in spring or early summer in the current year dealing with common law damages procedure will have application to Scotland.
§ Lord James Douglas-Hamilton[holding answer 18 April 1988]The civil justice review currently being undertaken by the Lord Chancellor applies only to England and Wales. The responsibility for recommending changes in the rules governing the procedures and practices followed in civil proceedings in the Court of Session and the sheriff court falls to the rules councils for those courts. The rules review group set up by the Court of Session is currently examining in detail the rules of that court with a view to ensuring that procedures are as efficient and expeditious as possible.
