asked the Secretary of State for Transport what information he has on the circumstances surrounding the reported near miss involving British Airways flight 328 and a Royal Air Force Hercules on 15 July and as to what details of the British Airways airplane's flight plans were transmitted to air traffic controllers in Prestwick; and if he will make a statement.

The Civil Aviation Authority through the national air traffic services is responsible for all matters concerning air traffic control.

The full circumstances surrounding the incident to which my hon. Friend refers are currently being investigated and will be subject to examination by the joint airmiss working group (JAWG) whose members comprise independent representatives of the aviation community.
