Mr. Bermingham

asked the Secretary of State for the Home Department (1) how many requests, broken down by special hospitals, have been received from special hospitals for his consent to be given for the powers detailed in section 41(3)(c) of the Mental Health Act 1983 to be exercised; and how many such requests are still outstanding;

(2) how many requests, broken down by special hospitals, have been received from special hospitals for his consent to be given for the powers detailed in section 65(3)(c) of the Mental Health Act 1959 to be exercised in the year ended September 1983; how many of those requests remained outstanding at 30 September 1983; and how many requests are still outstanding.

No records are kept of the numbers of recommendations received from responsible medical officers for restricted patients in special hospitals to be discharged or granted leave of absence, nor of recommendations from the Department of Health and Social Security for the transfer to other hospitals of those patients. Every effort is made to deal with such recommendations with the minimum delay consistent with the due performance of other urgent work arising under the Act, and with the responsibility of my right hon. and learned Friend to ensure that the safety of the public is not put at risk.
