§ Mr. Newensasked the Attorney-General whether the motivation or other related factors are taken into account in determining whether or not to prosecute in cases in which breaches of the Official Secrets Act are thought to have occurred or whether the same standards are applied regardless of this consideration.
The Attorney-General: In deciding whether a prosecution should be brought for breach of the Official Secrets Acts, all the circumstances of the case are taken into account, including, where relevant, motive.
