Mr. Higgins

asked the Attorney-General whether, pursuant to his statement in the House on 25 January, an individual having no connection whatsoever with a particular industrial dispute who joins a picket line is acting in furtherance of an industrial dispute.

So far as can be traced, there is no legal authority on this point. In the absence of authority, the best answer which I can give is that the question whether such an individual is acting in furtherance of a trade dispute depends on whether the court considers that his purpose is to further that dispute or is some ulterior purpose not connected with that dispute. This appears to be a question of fact in each case.
