Mr. John Evans

asked the Secretary of State for the Environment (1) if an elected member of a local authority may claim an attendance allowance from his local authority for an approved local government duty when he is in receipt of supplementary benefit from the Department of Health and Social Security;

(2) if an elected member of a local authority may claim an attendance allowance from his authority for an approved local government duty when he is in receipt of sickness benefit from the Department of Health and Social Security;

(3) if an elected member of a local authority may claim an attendance allowance from his local authority for an approved local government duty when he is in receipt of unemployment benefit.

Any councillor in a principal authority is entitled by statute to receive an attendance allowance for the performance of duties approved by his local authority, and that entitlement is in no way affected by receipt of social security benefits. However, a councillor's entitlement to such benefits may itself be affected by the receipt of attendance allowance.
