asked the Secretary of State for Scotland whether he will amend the regulations so as to allow teachers who are near the end of their career and who refuse to register with the General Teaching Council to retire with full pension rights.

The superannuation of teachers in Scotland is governed by the Teachers Superannuation (Scotland) Act, 1968, and the Teachers Superannuation (Scotland) Regulations, 1969.

A teacher's entitlement to retirement benefits depends entirely on the statutory provisions and I have no power to vary them.
