asked the Minister of National Insurance why Mr. Thomas Kerr, 8, Hermand Crescent, Edinburgh, has not been granted an old age pension under the Widows, Orphans and Old Age Contributory Pensions Act, 1925, in view of the fact that he completed a period of five years insurance on 24th May, 1948.

Mr. Kerr retired in March, 1943, with a superannuation allowance from an employment which was excepted from insurance for old age pensions purposes under the Contributory Pensions Acts. These Acts under which his claim had to be decided precluded the award of an old age pension to anyone entering insurance after age 60 following upon retirement with a superannuation allowance from such an employment. The decision that this provision applied in Mr. Kerr's case was confirmed on appeal by the independent referee.
